Superintendency
A Superintendent is a contractual role appointed under a construction contract to administer the agreement and facilitate the successful delivery of a project. While often engaged by the Principal, a Superintendent has a broader responsibility to act honestly, fairly, and in accordance with the contract, ensuring decisions are made consistently and objectively throughout the construction process.
Effective Superintendency is about far more than reviewing paperwork. It is about providing independent leadership, maintaining contractual certainty, and ensuring all stakeholders understand their rights, responsibilities, and obligations. Acting as the Principal's agent where permitted by the contract, a Superintendent may issue directions to the Contractor, approve construction programmes, review subcontractor appointments, manage contractual correspondence, resolve ambiguities within the contract documents, inspect and test materials, direct suspensions or postponements of work, and instruct variations where required.
In addition to these administrative functions, the Superintendent is often required to independently assess and certify matters that directly impact the commercial and contractual position of the project. This may include assessing extensions of time, evaluating liquidated damages, determining delay costs, valuing variations, certifying progress payments, issuing certificates of practical completion, preparing final certificates, certifying costs incurred by the Principal, and assisting in the resolution of contractual disputes.
